Our material

The Site and its contents are owned by Superyacht Holdings LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. SYH, SYH CLUB, and the SYH logo are marks of Superyacht Holdings LLC. Access to the Site grants no licence to use any of them. See Section 5 of the Terms of Use.

Third-party material

The Site includes material owned by third parties, including vessel photography, general arrangement plans, shipyard and vessel information, and references to third-party organizations. Such material is used for informational purposes and remains the property of its respective owners. If you own rights in material appearing on the Site and believe it is being used without authority, please contact us using the procedure below and we will act promptly.

Notice of claimed infringement

Superyacht Holdings respects the intellectual property rights of others. Consistent with the Digital Millennium Copyright Act of 1998 (the “DMCA”), we will investigate notices of alleged infringement and take appropriate action, which may include removing the material and terminating the access of anyone who repeatedly infringes.

Send a notice to our designated agent, with the subject line “DMCA Takedown Request”: Attn: Copyright Agent, Superyacht Holdings LLC, matthew@syhclub.com.

To be effective, your notice must be in writing and include:

  1. a physical or electronic signature of a person authorized to act on behalf of the owner of the right claimed to be infringed;
  2. identification of the copyrighted work or other intellectual property claimed to have been infringed;
  3. identification of the material claimed to be infringing, with enough detail for us to locate it on the Site;
  4. your address, telephone number, and email address;
  5. a statement that you have a good-faith belief that the disputed use is not authorized by the owner, its agent, or the law; and
  6. a statement, made under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act on the owner’s behalf.

Be aware that under 17 U.S.C. § 512(f) a person who knowingly materially misrepresents that material is infringing may be liable for damages.

Counter-notice

If you believe material of yours was removed by mistake or misidentification, you may send a counter-notice to the Copyright Agent above containing:

  1. your physical or electronic signature;
  2. identification of the material removed and the location at which it appeared before removal;
  3. a statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification; and
  4. your name, address, and telephone number, a statement that you consent to the jurisdiction of the federal district court for the district in which your address is located (or, if outside the United States, any judicial district in which SYH may be found), and a statement that you will accept service of process from the person who gave the original notice.

If we receive a counter-notice, we will forward it to the original complainant and advise that we may restore the material in 10 business days. Unless the complainant files an action seeking a court order, we may restore the material in 10 to 14 business days after receiving the counter-notice, at our discretion.

Repeat infringers

We will terminate, in appropriate circumstances and at our discretion, the access of anyone we determine to be a repeat infringer. We may also limit or terminate access for anyone who infringes the intellectual property rights of others, whether or not the infringement is repeated.
